A bus passenger who puts his luggage in an overhead rack reasonably expects privacy for his belongings, a right that police violate if they squeeze the bags in a search for drugs, the Supreme Court ruled today.

By a 7-to-2 vote, the justices reversed the conviction of a man who was discovered with a "brick" of methamphetamine in his canvas bag, ruling that he had been subject to an unreasonable search under the Fourth Amendment. A federal agent who had checked passengers' immigration status aboard a Greyhound bus in Texas found the drugs as he began feeling suitcases in the storage rack.

Chief Justice William H. Rehnquist acknowledged that the court previously had ruled that police observation of a backyard from a low-flying plane and of a greenhouse by a helicopter did not violate a reasonable expectation of privacy.

"But those cases are different . . . Physically invasive inspection is simply more intrusive than purely visual inspection," Rehnquist wrote. He said the critical factors in such Fourth Amendment cases are that an individual believes his property will remain private and that society considers that expectation reasonable.

As such, today's ruling is likely to affect bus and train passengers and not extend to airplane travelers in most circumstances. Air passengers who typically are subjected to various security checkpoints know their bags may be searched.

    경찰이 마약수색을 위해 버스승객이 머리 위 선반에 놓아둔 짐을 수색한다면 그 승객이 당연히 자신의 수하물에 대해 기대하는 프라이버시를 침해하는 행위가 된다고 대법원은 오늘 판결을 내렸다.

    7:2의 표결로 재판관들은 즈크가방에 메탐페타민 덩어리를 밀반입하다 적발된 한 남자가 4차 개정된 헌법에 따라 부당한 수색을 당했다고 판결하면서 이에 대한 유죄판결을 취소했으며. 그 마약은 한 연방요원이 Texas에서 Greyhound 버스 내 승객들의 입국서류를 확인하던 중 수하물 선반에 있는 여행가방들을 더듬어 조사하기 시작하는 과정에서 발견했다.

    대법원장 William H. Rehnquist는 과거 경찰이 저공비행으로 뒤뜰을 감시하거나 헬기에서 (대마를 재배하는) 온실을 감시했던 행위는 개인이 자신의 프라이버시를 적절하게 누릴 수 있는 권리를 침해하지 않는다는 판결을 내린 사실을 인정했다.

    "그러나 그 경우들은 사정이 다릅니다 ... 행동으로 직접 상대방에 대한 조사를 실시하는 것은 단순한 시각적 조사보다는 더욱 타인의 영역을 침해하는 것입니다," 라고 Rehnquist는 기록했다. 4차 개정헌법의 주내용은 개인은 소유 재산에 대한 프라이버시를 보장받는 것을 믿고 사회는 개인의 그 기대가 온당한 것으로 간주한다는 것이다.

    그러한 관계로 오늘의 판결은 버스와 기차의 승객들에게 영향을 미칠 것 같으나 대부분의 경우에 비행기승객에 까지 광범위하게 적용되지는 않을 것이다. 많은 검문과정을 거쳐야 하는 것이 통례인 비행기 승객들은 자신의 짐이 수색당할 가능성이 있다는 사실을 알고 있다.


    ▶ 문법
    "매일 아침 머리를 감는다"의 'I shampoo my hair every morning'이나 '여자들은 남자보다 샴푸를 더 많이 소비한다'는 'Women consume more shampoo than men do'의 표현에서처럼 현재의 습관이나 일반적인 사실, 진리는 단순현재시제(현재형 동사)로 표현하는 반면에 '지금 머리 감는 중이다'와 같이 현 순간의 동작의 진행은 'I am shampooing my hair now'처럼 현재진행형시제(am, are, is + -ing)로 표현한다는 너무나 쉬운 기초문법이 이번 주 학습요점이다.

    본문 첫 문장의 고딕체 부분이 단순현재를 취하는 이유는 대법원이 그 내용을 일반적인 사실 또는 진리로 보기 때문이다.

    Enjoy, finish, avoid, quit 등의 동사는 뒤에 동명사가 목적어로 오기 때문에 "나는 게임에 이기는 것을 즐긴다"는 'I enjoy beating others in a game'으로 표현한다.(I enjoy to beat...으로 표현하지 않도록 유의) 반면에 'Game에서 남에게 지는 것을 즐기지 않는다'의 수동의 의미는 동명사의 수동태 being + p.p를 이용, "beating"을 "being beaten"으로 변화시킨 다음 by(～에 의하여)를 위치시켜, 'I don't enjoy being beaten (by others) in a game'으로 하면 된다. 이때의 'being'은 의미가 없으며 단지 동명사의 수동태를 만드는 기능을 가지고 있다.

    Let me explain why that is a mistake in Korean.
    다음의 네 문장을 어떻게 보십니까? 형식이 서로 전혀 다른 문장으로 보십니까?
    1. I am happy.
    2. He is sleeping. (진행형)
    3. She is loved. (수동태)
    4. It is of no use.


    저는 그렇게 생각하지 않습니다. 위 문장은 '주어 + be + 형용사(구)'라는 공통된 문장 형식에 의해 이루어졌다고 생각합니다. 여기서 be동사의 뜻은 '--이다'가 아닌가요?
    1. I + 이다 + 행복한 = 나는 행복합니다.
    2. He + 이다 + 자고있는 = 그는 자고 있다.
    3. She + 이다 + 사랑받은 = 그녀는 사랑받는다.
    4. It + 이다 + 소용없는 = 그것은 소용없다.
    물론 위에서 be동사가 의미가 없다고 해도 사실 문제가 될 것은 없다고 생각합니다. 그렇다면 I am a doctor.에서 be동사의 뜻은 "--이다" 인데 I am happy. She is loved.에서 be동사의 뜻이 없다고 한다는 것은 조금 이상하지 않겠습니까?

    To make a sentence, you don't necessarily need "be"verb. The expression "I enjoy talking" is perfect in itself without "be", and when the sentence is switched to passive form, it should be expressed like this, "I enjoy being talked to(by people)."

    Here, "being" is gerund form of the verb "be", not present participle form as you said, and so it doesn't have the same meaning as "be" in the expression "I am a teacher" or "It is useless."

    "Being" in the expression "I enjoy being talked to" is used only to convey passive meaning of the gerund "talking."
