Can't help myself

 고용인이 장시간 거울 앞에서 몸치장하는 버릇을 못 고쳐 상습적으로 지각 및 결근을 한다면 정신장애자로 보호를 해야 할까, 아니면 당장 해고 시켜버릴까? 법 제도가 잘 발달됐다는 미국의 경우를 살펴보자.

Carolyn Humphrey, an otherwise excellent employee, compiled a history of tardiness and absenteeism because of grooming and dressing rituals that took hours, sometimes all day.

Humphrey sued the Modesto hospital that fired her, claiming the obsessive trait that drove her relentless primping had not been accommodated, as required by the Americans With Disabilities Act.

The 11-year-old disabilities act was designed to assure, among other rights, equal employment opportunities for people with physical and mental impairments.

Humphrey's attorney, Jerome Budin, says her ritualistic behavior "is as much of a disability as a missing arm or leg and should be protected in the same fashion."

Under the ADA, a disability is any impairment that substantially hinders a major life activity. Attorneys for Modesto's Memorial Hospital argue that Humphrey is not disabled within the meaning of the statute. -Sacramento Bee-

    다른 면에서는 나무랄 데 없이 뛰어난 고용인 Carolyn Humphrey는 몸치장과 옷 입는데 수 시간씩, 때로는 하루종일 보내는 이유로 지각과 결근의 대명사가 되어버렸다.

    Humphrey는 자신을 해고시킨 Modesto병원을 고소했는데, 그녀는 자신을 걷잡을 수 없이 몸단장하게 만드는 비정상적인 성격이 미국의 장애자 법에 의해 보호되지 않았다고 주장했다.

    11년 된 그 장애자 법은 다른 권리들 중에서 신체적, 정신적 결함자들에게 동등한 고용기회를 보장하는 취지로 제정되었다.

    Humphrey의 변호사 Jerome Budin은 그녀의 의식적 행동은 "팔이나 다리가 없는 것과 같은 장애이기 때문에 같은 차원에서 보호되어야 한다고 말한다.

    장애자 법에서 말하는 불구는 주된 생활에 필요한 활동을 실제로 방해하는 장애를 말한다. Modesto병원 측 변호사의 주장은 Humphrey의 장애는 법의 그 범주에 속하는 것이 아니다는 것이다.
