임신부가 마약을 복용해 태아의 건강을 해치고 있을 때 이 사실을 알고있는 병원 측은 속수무책이어야 할까? Washington Post 지를 살펴보자.
The Supreme Court today ruled that hospitals cannot administer drug tests to pregnant women without their consent and forward positive results to the police.
By a vote of 6 to 3, the court held that the drug tests conducted in the past by a Charleston, S.C., public hospital amounted to warrantless police searches of the women.
Mothers who tested positive faced charges not only because cocaine use itself is illegal, but also because, under South Carolina law, a viable fetus is a "person" and a woman who takes cocaine while pregnant may be accused of distributing illegal drugs to a minor, or of committing child abuse.
The hospital began drug-testing in 1989, during the crack cocaine epidemic, and turned positive results over to police. The policy was changed in 1990 to give drug-using patients a choice between being arrested or enrolling in drug treatment programs.
Ten women sued the hospital in 1993, saying the policy violated the Constitution. The hospital, which treats indigent patients, later dropped the policy, but by then police had arrested 30 maternity patients.

대법원은 오늘 병원측이 임신부들의 동의 없이 약물테스트를 실시해 나오는 양성반응결과를 경찰에 넘길 수 없다는 판결을 내렸다.
법정은 6:3의 투표로 과거 남부케롤라이나 주 Charleston 의 한 공공병원에서 실시되었던 약물테스트는 경찰이 영장 없이 그 여자들을 수색하는 것에 해당하는 행위라고 판결했다.
양성결과가 나온 산모들은 불법인 코카인 복용죄 뿐만 아니라, 남부 케롤라이나 주법에 의하면 자랄 수 있는 태아는 “사람”이기 때문에 임신 중 코카인을 복용하면 불법약물을 미성년자에게 배포하거나 어린이를 학대한 죄로 기소될 수 있다.
그 병원은 크랙코카인이 유행하던 1989년에 약물테스트를 시작했으며, 양성반응결과는 경찰에 넘겼다. 그 정책은 1990년에 마약복용 환자들에게 구속당하거나 또는 마약치료 프로그램에 등록할 수 있는 선택권을 주도록 바뀌었다.
1993년 10명의 여자들이 그 정책은 위헌이라고 주장하면서 병원 측을 상대로 소송을 제기했다. 가난한 환자들을 치료하는 그 병원은 후에 그 정책을 없앴지만, 이미 경찰이 30명의 산과 환자들을 체포하고 난 후였다.
