Nova Scotia women are free to breast-feed in public following the settlement of a human rights complaint against a Halifax shopkeeper who had asked a nursing mother to stop.

Under the deal announced yesterday -- a first for the province - the owner of Chintzy's Fabrics and Furnishings agrees that "henceforth women will be permitted to breast-feed in the public area of Chintzy's."

"If you're in a public place, like a restaurant or a store or a park, and somebody tells you to stop breast-feeding, that's against the law," said Lori MacLean, a spokeswoman for the rights commission.

The right to breast-feed in public is covered under sections of the provincial Human Rights Act that prohibit discrimination based on sex or family status.

Elizabeth Smith, a nurse and mother of four, filed the complaint alleging that the owner of Chintzy's, Jan Bird, asked her to stop feeding her six-week-old son in April, 1998, when a male customer entered.

Mrs. Smith was especially irked by the fact the owner was feeding her dog in the store at the time. "I said, 'It's pretty sad in here, when you can feed your dog and you can't feed your child," she said after the incident.

Yesterday, Ms. Smith said, "the settlement is going to allow women to breast-feed in public without discrimination."
